1 米国のマルコ・ルビオ国務長官は2026年8月18日、国際刑事裁判所(ICC)の赤根智子所長ら2人を新たに制裁対象にすると発表した。[1]
同長官は、去る2026年7月13日、政府全体が一体となってICCの活動能力を組織的に無効化し、米軍兵士や政府関係者を標的にしたり、その他の方法で米国の主権を脅かしたりする行為を阻止するキャンペーンを発表したばかりである。[2]
2 この間、米国トランプ政権は、度重なる国際法違反を犯しているイスラエルに対する裁きが下ろうとするやいなや、それを担う国際刑事司法機関をも攻撃の対象としてきた。このような行為は、国際法秩序を破壊する暴挙であって、決して許されるものではない。
米国の思惑によりICCが解体される事態となれば、時代はニュルンベルク裁判以前の状態へと逆行することとなる。現在の国際情勢ではICCに代わる機関を設立することは不可能であることは容易に想定できるところであり、戦争の違法化を目指してきた人類の取り組みに対して取り返しのつかない事態を招来することになる。
3 私たち自由法曹団は、人権と民主主義の擁護を目的とし、日本国憲法9条の理念を擁護実現することに意義を認めている。戦争や国際紛争における一定の行動に制約をかけるローマ規程は、憲法9条の精神と軌を一にするものであり、ICCへの圧力行動を座視することはできない。
私たちは、日本政府に対し、米国政府の脅しや制裁によるICCの機能を損なう圧力を厳しく批判し、直ちに同政府に対し、その暴挙を撤回するよう申し入れることを求める。本年1月7日、高市早苗内閣総理大臣は、赤根所長の表敬を受け、日本政府としてICC及び赤根所長を力強く支援していく旨述べたばかりである。その赤根所長を含むICC幹部が米国の制裁対象とされ、ICC解体のキャンペーンが進められているにもかかわらず、日本政府として黙認することは、高市首相の前記発言を反故にするものと言わざるを得ない。
また、日本政府を含むすべてのローマ規程締約国に対し、ICCを通じた「法の支配」に基づく国際法秩序を実現するためローマ規程86条等に定められた広範な協力義務及び国際法の守護者としての役割を果たし、米国の不当な圧力に屈せず、引き続きICCへの明確な支持と協力支援を表明することを求める。
くわえて、米国に対しては、大統領令14203号に基づく、ICC裁判官、検察官、職員及びその家族並びにICC協力者への不当な措置の即時かつ無条件の撤廃、ICCの包括的な無効化を目指すキャンペーンの中止、国際刑事司法機関の独立性を尊重する法的義務の承認をすることを重ねて求める。

Statement Demanding that the United States Cease Unjust Pressure on the International Criminal Court, Including Sanctions Against ICC Officials, and Calling on States Parties to the Rome Statute, Including the Government of Japan, to Support the ICC and Uphold the International Legal Order

1.On August 18, 2026, U.S. Secretary of State Marco Rubio announced new sanctions targeting two individuals, including International Criminal Court (ICC) President Tomoko Akane. [1]
This follows an announcement by the Secretary on July 13, 2026, launching a government-wide campaign to systematically neutralize the ICC’s operational capabilities and block any actions targeting U.S. military personnel, government officials, or otherwise threatening U.S. sovereignty. [2]
2.The United States’ aggressive targeting of the international criminal justice institution responsible for delivering accountability occurs precisely as the court prepares to rule on the relentless violations of international law committed by Israel. Such actions represent an intolerable assault on the international legal order and must not be condoned.
If the ICC were to be dismantled at the behest of the United States, the international community would regress to the era preceding the Nuremberg Trials. In the current international climate, it is readily foreseeable that establishing a viable alternative to the ICC would be impossible, presenting an irreversible setback for humanity’s efforts to outlaw war.
3.With our core objectives of defending human rights and democracy, we, the Japan Lawyers Association for Freedom (JLAF), are fully committed to upholding and realizing the ideals of Article 9 of the Constitution of Japan. The Rome Statute, which restricts certain conduct in wars and international conflicts, shares the same spirit as Article 9. Consequently, we cannot stand idly by in the face of coercive tactics targeting the ICC.
We call on the Government of Japan to strongly condemn U.S. government pressure that undermines the functions of the ICC through threats and sanctions, and to immediately demand that the U.S. government withdraw these outrageous measures. On January 7 of this year, Prime Minister Sanae Takaichi received a courtesy call from President Akane and explicitly pledged that the Government of Japan would strongly support the ICC and President Akane. For the Japanese government to tacitly condone this situation—while ICC officials, including President Akane, are targeted by U.S. sanctions and a campaign to dismantle the ICC is actively pursued—would constitute a direct retreat from Prime Minister Takaichi’s explicit commitment.
Furthermore, we urge all States Parties to the Rome Statute, including the Government of Japan, to fulfill their broad obligation to cooperate under Article 86 of the Statute. As guardians of international law, States Parties must actively support the realization of an international legal order based on the ‘rule of law’ through the ICC, maintaining unwavering, explicit support and assistance without succumbing to unjust U.S. pressure.
In addition, we repeatedly demand that the United States immediately and unconditionally rescind its unjust measures against ICC judges, prosecutors, staff members, their families, and those assisting the court under Executive Order 14203. The United States must halt its campaign to comprehensively neutralize the ICC and recognize its legal obligation to respect the independence of international criminal justice institutions.
